In South Carolina and North Carolina, injured employees cannot sue their employers — their benefits are limited to workers' compensation claims. However, they may be able to bring claim against another responsible party such as a manufacturer of a defective product which caused injury or the negligence of another contractor or subcontractor. These actors may be additionally liable to pay for damages.
However, there are certain time limitations within which claims for both workers' compensation and negligence-based claims may be brought. If these time limitations are ignored, individuals lose their right to all compensation.
